Gawker urges court to drop Quentin Tarantino lawsuit

Mar 11 2014, 5:14am CDT | by

Gawker is urging a federal court to drop Quentin Tarantino's 'Hateful Eight' lawsuit.

The website - which stands accused of copyright infringement by linking to a leaked script of the director's upcoming cowboy film, which he has since been forced to scrap - now claims the lawsuit should be dismissed because Tarantino hasn't cited actual copyright infringement, only ''contributory'' factors.

According to Variety.com, they said in a motion to dismiss filed in US District Court in Los Angeles on Monday (10.03.14) that the lawsuit ''does no more than raise the possibility that some member of the public who accessed plaintiff's script using Gawker's link subsequently violated Tarantino's rights by committing an infringement.

''Because plaintiff did not allege any facts showing that an infringing act actually was undertaken by a third party - merely accessing the script by clicking on the link is legally insufficient - plaintiff did not state a claim for contributory infringement.''

Gawker also claims that linking to an online version of the script was fair us because it hadn't ''reproduced'' the material.

They said: ''Gawker made minimal use of the script - it reproduced no part of it but merely linked to another publication. Gawker's use was, at most, incidentally commercial and did not usurp the primary market for and purpose of the script: to make a movie.''

The Oscar-winning 'Django Unchained' director decided to pull the plug on the movie and is demanding at least $1 million in damages for Gawker's actions.

He said he had only given the script for 'The Hateful Eight' to six people and believes one of them must have let their agent see it, who subsequently sent it on.

District Judge John Walter has scheduled a hearing in the case for April 14.

‘The Guest’ Is a Fun ’80s Throwback With Sci-Fi and Stalker Sprinkles on Top [Movie Review]

Sep 18 2014 8:00pm CDT | Source: slash film

Update from editor Peter Sciretta: The following review was published by Germain Lussier on January 19th 2014 from the 2014 Sundance Film Festival. The movie is out in theaters this week: The films by director Adam Wingard and writer Simon Barrett always have one thing in common. They are obviously influenced by an intense passion for movies, but are not overtly obvious about referencing those movies. In that sense, The Guest might feel like something you’ve se ...

Exclusive: Two Psychedelic Alternative Posters for ‘The Guest’

Sep 12 2014 3:00pm CDT | Source: Slash Film

This Wednesday, September 17, one of the coolest films of the year is coming to select theaters. That movie is The Guest, the latest film from the team behind You’re Next, and it is a “fun ’80s throwback with sci-fi and stalker sprinkles on top.” That’s what I said at Sundance, where the film premiered. Now, nine months later, you can finally see what all the fuss is about. Directed by Adam Wingard, The Guest stars Downton Abbey‘s Dan Stevens a ...

BBC Edited Out A Pretty Horrible Scene In Upcoming Episode Of Doctor Who

Sep 5 2014 7:09pm CDT | Source: movie pilot

BBC and everyone involved with Doctor Who must be breathing a sigh of relief that the episode titled "Robot of Sherwood" is airing this week, and not last. The timing of the episode allowed for BBC to edit out a potentially disastrous scene from a PR perspective. The climactic battle between Robin Hood and the Sheriff features a decapitation - fairly gruesome at the best of times, but an even more horribly mistimed scene right ...

BBC Edited Out A Pretty Horrible Scene From Last Week's Doctor Who

Sep 5 2014 7:09pm CDT | Source: movie pilot

BBC and everyone involved with Doctor Who must be breathing a sigh of relief that the episode titled "Robot of Sherwood" just aired this week, and not the week before. The timing of the episode allowed for BBC to edit out a potentially disastrous scene from a PR perspective. The climactic battle between Robin Hood and the Sheriff features a decapitation - fairly gruesome at the best of times, but an even more horribly mistimed scene right now in the wake of the beheadings of Ameri ...

WINTER’S TALE Blu-ray Review

Sep 2 2014 7:00am CDT | Source: Collider

Quentin Tarantino has complained about how one of the biggest problems with American cinema is that it’s afraid of big emotions.  Of melodrama that might descend into camp (or perhaps is camp to begin with).  And it’s true, more movies are likely to adapt an ironic distance than go for something earnest.  There’s a reason for that: when earnest doesn’t work, you get films like The Postman and The Room.  But that means some mate ...

How Japanese Filmmaking, Especially Anime is the Most Educational Thing for an Aspiring Filmmaker

Aug 24 2014 7:39pm CDT | Source: movie pilot

Being the film geek of my school I’m always asked, “What’s your favorite movie?” or “What are your top ten movies?”, and my response is always “I’ll get back to you on that”. I’ve honestly been meaning to but it’s really hard to create a list of my favorite films when I’m constantly remembering more and more films that stuck out to me. However the most interesting question I’ve been asked is “What films inspire you?”. This is a question I’d really like to answer so I think I’ll ...
